Testimly Terms of Service

These Terms of Service ("Terms") govern the relationship between Testimly ("Provider," "we," or "us") and each user ("Client," "you") using our testimonial collection and management services.

1. Service Description

Testimly provides a platform for collecting, managing, and displaying customer testimonials. Our services include:

  • Testimonial collection forms for video, text, and image testimonials
  • Cloud storage and hosting of testimonial content
  • Embeddable widgets for displaying testimonials on your website
  • Dashboard for managing and organizing testimonials
  • Analytics and performance tracking

2. Account Registration

To use Testimly, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

3. Acceptable Use

You agree to use Testimly only for lawful purposes. You must not:

  • Upload false, misleading, or fraudulent testimonials
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Use the service to spam or harass others

4. Content Ownership & Rights

You retain all ownership rights to the testimonials and content you collect through Testimly. By using our service, you grant us a limited license to host, store, and display your content solely for the purpose of providing our services to you.

You are responsible for obtaining all necessary permissions and consents from individuals who submit testimonials through your collection forms. You must comply with all applicable privacy laws and regulations.

5. Payments & Billing

Testimly offers both free and paid subscription plans. Paid plans are billed monthly or annually as selected. All payments are processed securely through Stripe. We do not store your full payment card details.

You can cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds are provided for partial billing periods.

6. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for any damages resulting from service interruptions, downtime, or data loss.

7. Data Protection & Privacy

We process personal data in accordance with our Privacy Policy. We implement industry-standard security measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security.

8. Limitation of Liability

To the maximum extent permitted by law, Testimly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in fraudulent or abusive behavior. Upon termination, you will lose access to your account and stored content. You may export your testimonials before termination.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Continued use of Testimly after changes constitutes acceptance of the updated Terms.
